PLEASE READ THE FOLLOWING INSTRUCTIONS CAREFULLY:
This agreement is between Flashcubes.ca and the customer named above in the section
"information about the organizer".
1) Method of payment
A deposit of $250 is required upon the signature of this contract and payable on behalf of FLASHCUBES and must reach our office no later than 30 days following the signature of the contract. The remaining balance is payable in the name of FLASHCUBES, in cash or cheque, on the day of the event upon arrival of the FLASHCUBES representative.
2) Date and time
The FLASHCUBES technician(s) will arrive one hour (60 minutes) before the time of the beginning of the photo booth activity indicated in this contract. This time can be changed by email up to 10 days before the date of the event. It is possible for us to arrive earlier if you choose the option ''Waiting time''. The number of hours of our packages is indicated in consecutive hours.
3) Delivery policy
If the event is more than 50 km from the center of Montreal, additional fees may apply as mentioned in point 1-N of this contract.
4) Damages, theft, and accidents
In the event of accident, incident, theft or damage to Photo Booth equipment, the CLIENT will be held responsible for paying the costs related to the repair and replacement of the damaged equipment. With respect to equipment breakage, the CLIENT may purchase FlashCubes insurance which protects all Photo Booth equipment installed at the event site.
5) FlashCubes Insurance
The CUSTOMER can purchase FlashCubes insurance which will cover any damage that may be caused to Photo Booth equipment and accessories during the activity. Flashcubes insurance is limited to breakage and damage to equipment and does not cover theft. Refer to clause 1-O of this contract.
6) Reimbursement, Interruptions and Mechanical Breakdowns
FLASHCUBES undertakes to provide a functional Photo Booth for the duration of the rental. The CLIENT understands and accepts that some maintenance (e.g., adding paper) may be required during the rental period, which could cause one or more minor service interruptions. In the event that one or more minor service interruptions are necessary, FLASHCUBES agrees to honor the total rental time.
In the event of a mechanical breakdown or any other situation that does NOT allow FLASHCUBES to operate for the remainder of the rental term, the amount will be prorated for the remaining hours and will be credited or refunded to the CUSTOMER at its convenience. This amount includes the rental time of the Photo Booth only.
7) Confidentiality, promotional emails, use of photos and movies
FLASHCUBES reserves the right to use the photos and videos created in Photo Booth for promotional purposes. FLASHCUBES may use certain photos and/or videos on its website, brochures, advertisements or professional social media page. The CLIENT may refuse the application of this clause before the date of the event by notifying it in writing to firstname.lastname@example.org. However, the CUSTOMER accepts that FLASHCUBES may send him/her promotional e-mails. FLASHCUBES disclaims all responsibility for the use of the photos taken in its Photo Booth.
8) Photo Bank on our Website
Within a maximum period of 24 hours, FLASHCUBES will send the CUSTOMER a link and an access code that will allow the CUSTOMER to download its photos. The FLASHCUBES team reserves the right to make the selection of the photos to be put on the web photo bank. The CUSTOMER may refuse this service at any time by writing to email@example.com.
9) Design creation
The CUSTOMER is responsible for sending FLASHCUBES the information related to the chosen design no later than 4 weeks PRIOR to the event. The CUSTOMER is entitled to a series of modifications to the chosen design, which will be named Version 2 (V2) to the design. Any other modification following Version 2 will be billed to the CLIENT at the rate of $99.99 per new version. This clause also applies independently to the background designs as well as to the customization of the Booth Camera.
In the event that we have not received the CLIENT's choice, a basic design will be selected according to the type of event by our team.
10) Responsibility of the customer
The CLIENT is responsible for:
(1) providing a 10 square foot (minimum) unobstructed space for the installation of the Photo Booth FLASHCUBES.
(2) provide a functioning independent 110v, 15-20amp power outlet within 20 feet of the location where the Photo Booth FLASHCUBES will be installed.
(3) Provide room and board per FLASHCUBES technician if applicable to 1-L and 1-N.
(4) Provide the exact address of the event and a cell phone number of a responsible person on-site at the time of the event.
(5) IF OUTDOOR EVENT, provide a CLOSED TENT or GASEBOARD with a minimum size of 10x10 feet to ensure proper operation of the equipment.
11) Weather Conditions
FLASHCUBES reserves the right to take a break or cancel an outdoor event in case of risk to its weather-related equipment. Thunderstorms, strong winds or temperatures below 10 degrees Celsius or above 28 degrees Celsius are some examples of weather phenomena that could cause equipment malfunction. No refunds will be made to compensate for breaks and/or cancellations due to weather conditions and the balance due under this contract must be paid in full.
In case of cancellation, the initial deposit will not be refunded. In the event of full payment, the remaining balance may be credited to the client for a future event.
13) Election of domicile: For the purposes hereof, the parties elect domicile in Mirabel, Quebec, Canada.
